
1. The Present General Conditions (the « General Conditions »)
In the General Conditions, the term « we » names FMCA agency and the term « you » names the customer. Furthermore, terms beginning with a capital letter are defined terms appearing in the list at the end of the « General Conditions ». The General Conditions as well as Your Order constitute the contract that we conclude with you for the furniture of the Products. All other general conditions will be inapplicable. The Contract cannot be modified unless we accept to modify it by letter or by e-mail.
2. Submit Your Order
2.1 To order, you must be 18 years or older.
2.2 How to order:
2.2.1. By filling in the Order Form available on the Web Site "FMCA Agency" and by clicking the icon "Order
2.2.2. By calling the number +41(0) 26 912 22 38 between 8 oclock AM and 17 30 PM from Monday to Friday
2.2.3 By filling in the Order Form and sending a copy by fax to the following number +41 (0) 26 912 11 46
2.2.4 By filling in the Order Form and sending a copy by mail to the following address: Agence & Cabinet FMCA, Rte Principale, CP 40, CH 1628 Vuadens FR (Switzerland).
You must use the Order Form on the Web Site "FMCA Agency". We accept only orders of the type described above.
2.3 By ordering, you order us to buy the Products that you have chosen on the Web Site "FMCA Agency ". We reserve the right to accept or to refuse this order by our own discretion. If we accept the Order, we will confirm it by the device of a Confirmation of Order. This Confirmation of Order will be sent to you by e-mail, or by mail in the case you had not indicated your e-mail address on your Order Form. The Confirmation of Order will be effective as of the date of shipment.
2.4 If we do not accept your Order, we will contact you by e-mail or phone.
2.5 The information on the Web Site "FMCA Agency does not constitute our contractual supply to deliver Products, but a simple invitation to enter in negotiation.
3. Prices
On the Bill of FMCA Agency the prices of the articles you ordered are indicated. Our prices go without export taxes from Switzerland. The import tax and the local value-added tax are not included in the purchasing price. On the other hand, the charges of expedition are worldwide included in the purchasing price for all articles.
4. Pay of your Products
4.1 You can pay according to the form of payment indicated on the Web Site "FMCA Agency".
4.2 You have to pay the full amount of your bill in Swiss francs according to the indication on your Bill.
4.3 If you pay with credit card, you have to supply the necessary information of your credit card when you submit your Order. Your credit card will be debited when we issue your Bill at the date of product delivery.
5. Delivery of Your Products
5.1 We do not deliver our articles to the following countries: USA, Canada, Mexico.
5.2 Unless particular agreement on our part, we deliver your products to the billing address of your credit card like indicated in the Confirmation of Order.
5.3 We will do our best to deliver the Products in time.
5.4 The transfer of the possession and risk relative to the Products are involved at the delivery.
6. Your Right to Return the Products
6.1 If you should not be satisfied with the Product you have bought in our shop you can return it to sender and obtain the refund if you contact us in the delay of seven working days counted from the delivery date.
6.2 In order to carry out your right to return a Product that does not satisfy, you have to call +41 (0) 26 912 22 38 between 8 oclock AM and 17 30 PM from Monday to Friday, to define the modality concerning the restitution of the Product.
6.3 We will pay back the purchasing price of the Products you have returned.
7. Two Year's Guarantee
All watches have got a two year's guarantee from the date of purchase (billing date) against defaults of material or fabrication. When we repair or replace watches by virtue of this guarantee, they are covered by the guarantee during the remaining period of guarantee. Repaired or replaced pieces have got a 90 day's guarantee if the reparation or replacement has happened between the 10th month and the end of the year's guarantee.
7.1. Exclusions
The guarantee does not cover:
- Injuries caused by accident, bad utilisation or neglect;
- Injuries caused by exposure of the watch to an inadequate environment (including an excessive temperature, an excessive light or fire, etc.)

9. Protection of Data
By ordering, you agree to the fact that we can stock or use the personal data collected from your order
10. Act of God
We will not be responsible for all loss or injury caused by our delay in execution of one of our obligations or lack of any part of our obligations in accordance with the Contract, if such delay or lack is caused beyond a controllable circumstance.
11. Applying Law and Jurisdiction
11.1 Swiss law governs the Contract.
12. Defined Terms
12.1 In the present General Conditions:
- "Order Form" means the electronic formula of order figuring on the Web Site FMCA Agency
- "Order" means a submitted order by your attention conforming to the dispositions of this present General Conditions
- "General Conditions" means the present terms and conditions;
- "Contract" means the contractual unity constituted by the General Conditions and your Order
- "Bill" means the bill that we send to you for the payment of the Product's price
- "Business hours" means all days except Saturdays and Sundays and public holidays in Switzerland or Liechtenstein
- "Product" means all products listed on the Web Site "FMCA Agency"
- "Web Site "FMCA Agency" means our Web Site.
